Apparently minor trauma to the head can lead to brain damage that can have a profound and debilitating affect on person’s life. Mild head trauma can leave the victim feeling outwardly unaffected and often the brain damage goes unnoticed. In many instances the brain damage is either left untreated or mis- diagnosed. Analyzing the brain function is a complex process and it can be difficult to ascertain the long term effects of the brain damage immediately after an accident. This is especially true there when there appear to be no obvious short term affects on the victim’s health and when there is physical manifestation of the brain injury.

Brain injuries are usually categorized as mild, moderate or severe with the diagnosis depending on various factors. The factors used to diagnose a brain injury include loss of consciousness, whether there is a loss of memory; whether there was any noticeable neurological damage such as loss of motor coordination, loss of sensory perception; or loss or affected speech. Moderate and severe brain damage are usually accompanied with symptoms evident in the immediately after an accident. Mild brain damage can be more difficult to diagnose.

Unfortunately mild brain injuries go untreated and often lead to long term or lasting effects on the physical and emotional well being of the injured. A major problem with diagnosis is that the symptoms may appear to be completely unrelated to the initial brain injury. There are many possible manifestations of the brain injury. The physical effects of brain damage can manifest in a stiffness in muscles, muscle weakness, dizziness or difficulty with balance, falling over; clumsiness, migraines or headaches, tiredness and fatigue, seizures, loss of sight, loss of hearing, loss of speech, stuttering.

Mild brain injury could also lead to cognitive deficits, loss of memory, confusion and difficulty in retaining attention, a slow down in processing information, loss of the ability to read, loss in the ability to write, loss of hand eye coordination, loss in the ability to make sense of objects and the relationship between objects.

Mild brain injury can also lead to emotional difficulties such as becoming irritable and tense.

The injured may also see mood swings, or laugh or crying at inappropriate moments and at inappropriate things. Someone with an untreated damage causing emotional problems may even begin to act odd or unexpected in social situations.

There are statute of limitations which impose a time limit to make a personal injury claim. There are different time limits for each person depending on the specific situation which could range from six months to several years, but it would be risky to wait more than a few months to consult a personal injury attorney. There are simply to many different situations and too many factors affecting the time limits to file a lawsuits. When the brain injury is severe enough there may a tolling of the statue meaning the statute is extended, but the injury has to be so severe such that the personal injury victim cannot take care of himself or herself. In which case there has to be someone appointed to file a lawsuit on behalf of the victim, but many instances of mild brain damage do not result in such extremities.

Following an accident the victim should speak with a personal injury attorney to insure a claim is timely filed. A personal injury attorney can be instrumental in assisting obtain optimum

Wrongful death attorneys are helpful in defending and in asserting your rights in wrongful death matters. In a wrongful death claim the family of the deceased will claim that the deceased died as a result of negligence or other liability on the part of the defendant. The surviving beneficiaries and dependents are entitled to monetary damages because of the defendant’s actions and conducts.

Wrongful death law describes the rights and duties of the respective parties. The laws pertaining to wrongful death seek to provide financial compensation to the heirs of a deceased, when the death was caused due to negligence, omission, wrongful acts or default of another. Meaning the laws seek to compensate the heirs when someone failure to act reasonably caused the death of the deceased or was a substantial factor in bringing about the death of the deceased.

As in most wrongful civil conduct there are no federal statutes for wrongful death, so each state has made its own set of civil wrongful death statutes and the laws vary from state to state a little bit. Compensation depends on several factors, such as the age of the deceased, the income the deceased earned from all sources including activities other than work. The greater the income the greater the claim. The younger the deceased likewise the greater the expected life time earnings. There are no exceptions for children, but the compensation is often lower because they are not expected to earn any income. There are also other factors such the involvement of the deceased in everyday activities with the survivors. A recently separated spouse would likely be entitled to less than a spouse that had just renewed her wedding vowels.

Wrongful death can be caused in many different ways including medical malpractice which results in the deceased’s death, neglect or abuse on part of the staff at a nursing home, as a result of a car accident, a bus accident, a train accident, a plane accident, a boating accident, and numerous other accidents. The issue is always whether the defendant did something wrong.

The spouses and the children of the deceased may file wrongful death lawsuits, and if there were not children or spouse, then other immediate family members may file suit. They heirs are entitled to monetary compensation to make them whole for the damage they suffered.

The compensation can includes loss of support, society, companionship, and also medical and funeral expenses and services.

To initiate a lawsuit there are time limitations which vary depending on the specific circumstances leading to the death and the specific state where the death occurred.

A grieving family is not likely to think about making a wrongful death claim, but unfortunately the law works against those that wait. A wrongful death claim is a very serious matter and the heirs should consult with an attorney as early as possible. In some cases consulting with an attorney after six months have elapsed may be too long. It is advisable that potential claimants consult with an attorney as soon as possible.

Auto accidents are the most common type of incidents giving rise to personal injury claims requiring the hiring of a personal injury attorney. Besides auto accidents there are other common accidents which include bicycle accidents, motorcycle accidents, truck accidents or even boat accidents all of which can result in severe personal injuries and death.

Failure to exercise reasonable care in the operation of car is the primarily reason why car accidents occur. Irresponsible driving is the main cause of auto accidents all over the world, but not all countries have personal injury laws to protect the injured. Drivers of vehicles have a responsibility obey the rules of the road and to exercise care and adjust for changing conditions such as changes in the weather. Failure to act reasonably results in injury to some innocent people who suffer and whose lifestyles are suddenly compromised.

Serious injury can occur when auto collides with a bus, car, or truck. Some serious injuries result when an auto hits a pedestrian or a cyclist. In both the cases the parties can get injured and both may have suffer consequences.

To determine which party is responsible for the accident a personal injury lawsuits is usually not required. The case is taken to court to make a determination as to the extent of fair and just compensation. The party held responsible for the mishap generally has to pay to compensate the other for all the damages including pain and suffering, loss of income, medical bills, and property damage. .

Damages can be to the body, the mind and to physical property damage. The vehicle of the victims might be damaged beyond repair in which case the fair market value of the vehicle has to be paid. When the victims are suffering from severe injuries there is often a job loss or reduced income. Injured persons need medical care which can be very expensive. The compromised lifestyle might also be stressful and depressing; so the victims suffer from mental stress and trauma. All these damages are reduced to a dollar sum and compensation is paid in money. Monetary compensation is intended to put the victim back to where he should have been if the incident had not occurred.. This is an effort to help the injured return to their normal lifestyle.

To insure all rights are protected and the optimum compensation is obtained the personal injury victim should consult with a personal injury attorney. The personal injury attorneys should be licensed to practice in the state where the incident occurred. If the accident occurred in San Diego County California, then a San Diego Personal injury attorney should be retained, even the injured lives in Nevada.

Following the car accident the personal injury claimant should take several steps to protect his rights.

When the injuries are severe there is not much the victim can do, but others can and should immediately call for an ambulance. The police should be called next and the events leading to the injury should be recorded.

If a camera is available or a store where a camera can be purchased pictures should be taken of the location of the vehicles, skid marks, and the injuries to the injured. In many instances there is no immediate bruising or bleeding. Most injuries are not visible to the eye, but some fractures cause severe distortions of the limbs and those should be photographed. This type of evidence can lead to a much better and much quicker resolution.

Collect contact details of witnesses. Occasionally a case can be successful or fail because of a lack or availability of witnesses. This is especially true when the claim is that one of the parties ran a red light.

The injured should consult a personal injury attorney as soon as possible. Not having a personal injury attorney can lead to problems with proving a case and with obtaining fair compensation. Also there are instances where the statute of limitations is very short.

A devastating incident that leads to severe injuries results in set backs to people’s lives and often life just seems to stand still for months. Harmful injury causing incidents come all on a sudden without giving people a clue.

The subtleness of a life changing accident often makes people indecisive. A personal injury causing severe pain and suffering allows the injured to think only of obtaining medical care and treatment. Mental trauma only makes the situation more difficult. Following a major live changing even the injured experiences many problems arising out of the same accident. The injured needs help with medical care, filing a police report, repairing damaged car, applying for income substitution benefits, and informing his employer of his inability to return to work, all family responsibilities and monthly bills continue, they don’t disappear or go on hold because of the life changing event.

The injured also need legal guidance. It is important that the injured speak with a personal injury attorney following a major accident. Failing to obtain legal representation following a major accident can adversely affect the personal injury claim and following a personal injury lawsuit the things the injured party did wrong will become evident. Injured persons often are overwhelmed with things that need taken care following an accident, such that they postpone speaking with a personal injury attorney. This single step can solve a lot of problems and save a lot of time to the injured a personal injury attorney can help out with many things and will assume responsibility with many things pertaining to initiating a personal injury claim.

Personal injury attorneys help the injured get fair compensation and statistical data shows the injured do much better in terms of the amount of recovery than the injured do on their own, this is especially true on more severe injury cases. A personal injury attorney will not stop the injured’s suffering or change the negligent behavior of others, but certainly do a lot to put you back where you should have been if the incident had not occurred at all. A personal injury attorney helps insure that the offending party pay for what they did. That is what personal injury attorneys make possible.

It is best to select personal injury attorneys that work in the state where the incident occurred. If the person was injured in California and lives in Arizona, then a California license personal injury attorney should be retained. Further if the incident occurred in a San Diego County then the injured should obtain a San Diego personal injury attorney.

Most personal injury attorneys will not file a personal injury lawsuit right away, but will wait until the injured is close to recovery. After recovery many personal injury attorneys are able to resolve the claim without filing a lawsuit, for the remaining claims a lawsuit is filed. The personal injury lawsuit is then filed on behalf of the injured party. Very few personal injury lawsuits go to trial. The personal injury lawsuits that go to trial generally involve disagreement as to liability or the severity of the injuries.

When personal injury lawsuits go to trial the personal injury attorney works with the injured to insure they are prepared for trial and know what will happen. In the vast majority of cases personal injury attorneys do not charge fees, until the case resolves in favor of the injured and no fees are paid until the defendant pays. Personal injury attorneys are paid a percentage of the sum recovered for the injured and if nothing is recovered the personal injury attorney recovers nothing.

In personal injury claims there are basically two options. A personal injury lawsuit can be filed or there can be an out of court settlement. The settlement offer follows a demand by the personal injury attorney for payment for damages. When a settlement cannot be reached the injured has the option of pursuing a lawsuit. Personal injury attorneys can only advise as to what is best, but the ultimate decision is actually left to the injured party not the attorney.

The art of clear thinking is a learnable technique that will help you to sharpen your mind and allow you to cut through rhetoric and evaluate the reasoning (if any) behind the words.

To initiate this process, I want to show you six common fallacies, which blur accurate analysis of ideas.

Learn them and apply them every day.

Democratic fallacy

Unreliable reasoning that stems from the idea that the “majority opinion” is a source of truth and a reliable guide for action.

This is a very dodgy way to discover “Truth”

For example;

Imagine a passenger aircraft is having engine trouble.

Would it be right for the pilot to hold a vote as to whether they should attempt an emergency landing?

If not, why not?

Is the majority opinion in the office a reliable guide to intelligent action?

Can a million people be wrong?

Be careful if you are tempted to reinforce your argument with the cry “everyone else thinks so, too.”

Correlation-cause confusion

Correlation-Cause confusion is a common trap that people fall into. Just because two things occur at the same time does not necessarily mean that one caused the other.

It is a mistake to treat a correlation as a causal connection

If I put on my lucky ring, and I go out and find a ten pound note, did the ring cause it to happen?

If a new boss comes to work and the sales next month go down, what does it mean?

Getting personal

Getting personal is the mistake of dismissing an idea because of the person suggesting it.

Imagine an overweight scientist has done research to prove that exercise reduces the risk of heart disease.

You could be tempted to say, “What does he know? Look at the state of him!”

Or you could say “He should practice what he preaches” and dismiss the valuable idea.

Halo effect

Halo effect is the reverse of the above. It means that you give extra credibly to an idea because of the person.

For example Elvis Presley was asked whether he thought the Americans were right to be at war in Vietnam.

He wisely answers ” I don’t want to get into that. I am an entertainer. Ask me about my music”

I remember a radio programme asking agony-aunt Claire Raynor what she thought about the state of the criminal justice system in England and Wales.

What specialised knowledge does her opinion carry?

Separate ideas from the person proposing them and evaluated an idea as a “thing” in its own right. Determine if the idea can act as a guide to intelligent action.

Arbitrary assertion

Is an unsubstantiated statement of belief with no principle, reasoning or sensory evidence to support it.

It is a mistake to grant plausibility to an assertion simply because it is forcefully delivered or repeated.

Frequency and volume should never take the place of logic in your decision to accept an idea as true.

Napoleon once quipped “Repetition is my strongest argument” (and then lost 250,000 in his disastrous Russian campaign)

Equally, it follows that you should avoid trying to convince someone else by simply becoming louder and more passionate. Instead strive to make your reasoning inescapable.

Gamblers fallacy

Is the mistaken belief that your chances of winning increases the longer you play.

This is a false idea.

If you are doing the wrong thing it makes no difference how long you do it. It still will not work.

If your current plan has not been yielding any meaningful results, it will not change fortunes tomorrow.

* Change your ideas.

* Change the plan.

* Change the actions.

* The results must and will change.

Critical reasoning to develop clarity of thought will cause you to do three things:

You will:

* Listen more intently

* Ask more questions

* Think more before you make your decision

All of these will help you get better results

Four step formula for constructing an argument

1. Make sure that the reasons/evidence you offer are relevant to the conclusion. (Ensure your reasoning has no fallacies).

2. Is your conclusion the best based on the reasons or evidence? Ask, Is this conclusion justified.

3. If your conclusion is for some new action or policy, can the policy be carried out practically?

4. Consider the counter arguments that could weaken your position. Make sure you have accessed all relevant information.

One of the more unusual but sometimes profitable real estate investments is buying parking spaces. In every large city, including Chicago, there is always a need for parking and demand outpaces supply. Even with public transportation readily available in large cities, the high gas prices and the growing trend of green living and conservation, Americans still love their automobiles. Parking spaces are always going to be needed, and there are investors who are banking on it.

In Chicago, Mayor Daley is proposing lowering the number of unpaid parking tickets from three to two before you get booted. Right now it costs $60 to get a booted car back, along with paying all tickets owed. A booted car will be towed after 24 hours, so you could have an additional towing fee of about $150 plus storage costs. It could add up to several hundred dollars in a few days. Records show that there were almost 59,000 autos booted in Chicago last year (2007), so there obviously is a need for parking that isn’t being met.

So how much does a deeded parking space cost? It depends on where you are located. In New York, it’s possible to pay more than $175,000 for a prime parking spot. In Chicago, deeded parking spaces run anywhere from $20,000 to $65,000 or more in some of the trendy new construction high-rises or downtown locations. High profile developments like the Chicago Spire listed here http://www.bestchicagocondos.com/pre-construction-condos/chicago-spire.html usually allow for parking for all of its future residents for a fee in addition to the condo price. Some buyers will opt for a second space if one is available and others may decide not to purchase one at all. In many smaller Chicago real estate developments, no parking is offered with the condos.

According to Parkingsearch, the value of parking spaces has increased by quite a bit over the past few years. Their research finds that in Chicago the average parking space sold for $28,000. By 2006 that increased to $30,000 and last year in 2007 it was about $33,000. With a fixed rate loan of 6 percent there is definitely a profit to be made. It may be a bit if a challenge to find a bank to loan you the money, but it is certainly doable. You monthly payment should be in the range of $200 and the going rate for renting a parking space in prime spots can be as much as $300 to $500.

You need to keep in mind that you’ll have a few fees associated with owning a parking space. It isn’t all profit. While you won’t have much upkeep on the spot, you will probably have to pay a maintenance fee to the building or condo association. A deed must be obtained, liability insurance is a good idea and yearly taxes must be paid.

When looking for a good parking space investment, factors such as the garage being heated, secure entrances and what level or floor the spot is located on if it is a multi-level garage all come into play. Also whether or not there is an elevator can increase the value. You should also do your research and see how well the units in the building have sold. Buying a parking space in a building that is only half sold or rented won’t be a good investment.

Some real estate agents may be able to help you find available parking spaces and many developers are turning to auction houses to liquidate condo inventory, including parking spaces at a deep discount. Around 27 spaces at Millennium Center were auctioned off this past spring, and 10 of those were sold absolute. The suggested opening bid for those spaces was $10,000 to $12,000 and they had been priced at $49,000 to $65,000 each.

Parking spaces as investments may have never occurred to you, but the next time you get a parking ticket or find your car booted, it may sound like a fantastic idea.

For parents, sending their children off to college is a major milestone in life. Besides facing the empty nest syndrome, they are also confronted with the high cost of college tuition. Many parents try to defer some of that expense by opting out of traditional dorm housing or renting an apartment for their student and decide instead to buy a condo for them to live in as an investment. While there are some valid reasons to invest in a condo for college students, there are also some facts you need to consider that may change your mind.

With the recent downturn in the real estate market, making any kind of condo purchase should be well thought out before hand. The Chicago real estate market hasn’t suffered as badly as some other areas of the U.S., but there is still a glut of inventory and reselling may take much longer than you anticipate. Most experts say that it takes about six to seven years of home ownership before you can sell at a profit, so with a typical college education only taking four years, your condo won’t have enough time to appreciate. Another factor to consider is that towns or neighborhoods that have large colleges often get a reputation as being a “party town” and aren’t as appealing to the typical home buyer. The value of the condo may not appreciate as much as one in another neighborhood would.

There are plenty of resale condos like the ones listed here http://www.bestchicagocondos.com/resale-condos/index.html as well as student oriented housing such as Ivy Hall at University Village. You can find just about any size condo in any price range in Chicago right now, so there is no shortage of homes if you’re looking to invest.

The main areas where parents often miscalculate are how much the condo is going to cost in the long run in terms of maintenance and fees, how much their profit will be when they sell and how well their child is going to be able to take care of the property on their own.

There are going to be expenses besides your monthly mortgage payment. Utilities, maintenance, taxes, condo association fees and insurance are just a few of the other costs associated with owning a condo. Liability insurance is a must, in the event that an accident takes place at a college party held at the condo and you are held responsible.

That brings up the other point about your child’s level of maturity or responsibility. Is he or she willing or able to take proper care of the condo, including cleaning and keeping visiting friends from damaging the property in any way? College is challenging, and some students may not be up to the added pressure of taking care of a condo. And if they aren’t into housekeeping, that means either you will have to do it or hire a service, which is another expense.

Also consider that there is a possibility, for whatever reason, that your child won’t want to live there for four years. He or she could decide to switch colleges, drop out, join the military or any number of other scenarios. They might even decide they are missing out on student life and want to move into a dorm after a few months. Then you’ll find yourself stuck with a condo, mortgage and no tenant unless you can find a suitable renter.

As for profit, you should sit down and carefully figure all of your expenses, including the mortgage. If you get an adjustable rate mortgage, those usually have a lower fixed rate for the first few years before the rate increases, so you could reasonably take advantage of that and sell the home before the higher rate kicks in.

Buying a condo for your college bound son or daughter may seem like a great contribution to their education, well-being and overall happiness all while making a profit for yourself. But any type of real estate investment carries a certain amount of risk, especially if you are counting on turning it around and selling in four years. Perhaps the best reason to purchase a condo for a student is not for a quick profit but for experience and long term investment.

When projects do not make it to deadlines, there are many things going on behind the scenes. As an accidental manager, you are tasked to keep the boat on an even keel with few resources and people. Project management training can help you man the ship effectively and take on more projects.

When Do You Need Project Management Training?

The boss has tossed you a small scale project, which turns out to be a titanic assignment for you because you do not have the skills to manage different capabilities and organize the whole show. Yet you take on the task hoping you pass muster and reap accolades for a job well done. You are one of the thousands of befuddled managers needing project management training.

Here is why you need project management training:

* You cannot produce a credible project plan

* Your project goes helter-skelter in different directions

* Your risk management techniques are outdated or implausible

* You cannot estimate work schedule confidently

* Your monitoring tools are inadequate or inapplicable

* You cannot run a motivated team

* You lack leadership skills

Can tell your boss no? Or do you take the project and hit the books because your boss expects you to effectively run a project with few people and resources, on a tight schedule, and get maximum results?

What Is Project Management Training?

The project management training educates project managers to foresee dangers that may derail project plans and activities. They should be able to minimize risks and solve problems head on to make sure that the project is completed successfully notwithstanding the risks. If you had the opportunity to have this training early on, no projects would be too big or difficult to handle.

The training also takes up management of IT skills when overseeing a project. This is a convenient and faster way to keep tabs of what is happening to all actors participating in the project. Instead of lugging journals, logbooks, and calendars, you log on to your PC and look at the worksheets of everybody to check how the work is going.

Knowing the IT part of project management training is just an aspect, but the bigger picture is effectively managing resources and meeting the project deadline because extended or delayed project activities incur more expenses, and the company loses revenues.

Why is the Project Management Training Important?

Projects, big or small, need a good manager to keep the project going on schedule. There is the competition to think about and the revenues to be earned from the project. During the course of the project, there will be slip ups or the project may go full steam ahead; a good manager will answer the following questions:

* What factors contributed to the success and failure of the project?

* What were the frequent problems that cropped up and why?

* How much resources were used and how were these used?

* Were resources available at the right time or not, and why?

* Were the skills required available and competent?

* What were the lessons learned?

* Were all aspects of project implementation documented accurately?

* Did management respond to issues quickly?

Project management training will help you see the big picture. The questions mentioned earlier are your guideposts to become an effective manager; hence, the training is important on two counts – career advancement and project success. Need you ask more?

Don’t pass up project management training. You can always get PMI exam prep to help you hurdle your PMI exam. Get more details from threeo.ca now.
